E-Verify, a controversial web-based system administered by the Department of Homeland Security, is being used by an increasing number of businesses across the country to verify employees' eligibility to work in the United States. For most employers, use of E-Verify is optional. However, for many employers that perform contracts and subcontracts on behalf of the federal government, E-Verify is required. Several states, as well, require employers and contractors to use E-Verify in order to qualify for state contracts and benefits and legislation expanding E-Verify requirements is pending.

Because of the increasing requirements for employers to use E-Verify laws, it is critical for HR professionals to have a solid understanding of the E-Verify system. E-Verify is fairly simple to use, but it is important for employers to understand the requirements and the potential pitfalls before enrolling.
